amandla.mobi is an independent, community advocacy organisation that seeks to build a more just and people-powered Mzansi.
To do this we’re working to turn every cell phone into a democracy building tool so that no matter where you live; what language you speak or what issue you care about, you can take action with others. We do this through providing inclusive access to information and tools on cell phones, and where we can, in multiple languages.

1. DEFINITIONS
In these terms and conditions, the following capitalised words shall have the following meanings:
“Content” means all material including, without limitation, text, video, graphics and audio, published on the Website, whether copyright of amandla.mobi or a third party;
“Intellectual Property Rights” means all patents, designs rights, trade marks, trade and business names and all associated goodwill, rights to sue for passing off, copyright, moral rights and related rights, rights in databases, domain names, rights in information (including know-how and trade secrets) and all other similar or equivalent rights existing now or in the future in any part of the world, in each case whether registered or unregistered and including all applications for, and renewals or extensions of, such rights for their full term;
“amandla.mobi” means the amandla.mobi NPC.
“Website” means this website.
“Mobile Channels” means communication through our USSD codes, SMSs, Whatsapp etc.
2. ACCESSING THIS SITE
1. By using the Website and/or our mobile channels, you agree to be legally bound by these terms and conditions, which shall take effect from your first use of the Website and/or our mobile channels. If these terms and conditions are not accepted in full, the use of the Website and/or our mobile channels must be terminated immediately.

7. UPLOADING MATERIAL TO THE WEBSITE

Where you are invited to submit any contribution to the Website and/or our mobile channels (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant amandla.mobi a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in amandla.mobi’s privacy policy. If you do not want to grant to amandla.mobi the rights set out above, please do not submit your contribution.
2. Contributions must be your own. They must not contain any unlawful content and they must not infringe the law, nor be racist, sexist, classist, homophobic, ableist or any other content that is not in line with the values of amandla.mobi and our community of members. 5. amandla.mobi has the right to remove any material or posting you make on the Website and/or our mobile channels if, in our opinion, such material does not comply with these terms and conditions.
8. VIRUSES, HACKING AND OTHER OFFENCES
1. You must not misuse the Website and/or our mobile channels by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.

11. ONLINE DONATIONS
1. Acceptance of online donations; amandla.mobi accepts online donations via its website using an online donation form. Donors can make a single or monthly donation to amandla.mobi.
2. Donation Policy; All donations made to amandla.mobi underlie the amandla.mobi Donation Policy.
3. Refusal of donations; amandla.mobi reserves the right to refuse donations and reimburse the donor should it be found that the source of the money is not in alignment with our Donor Policy and contradicts the values that amandla.mobi stands for.
4. Cancellation of donation; Donors can cancel their monthly or annual donation at any time via email [email protected]. Please note that amandla.mobi cannot refund any donations that have already been processed for past months or years.
5. Refund of donations; We have a refund policy in case you make a donation in error. If you contact us within 7 days of making the donation we will return it to you within 40 days. However we will only be able to refund you the amount you donated, minus any costs outside of our control, such as any payment processor fees.
6. Donor Privacy policy; amandla.mobi shall take all reasonable steps to protect the personal information of users/ members in line with our privacy policy. However as per our donation policy, any donation over R10,000, we publish the source in our Annual Financial Statement.
7. Payment options accepted; Payment may be made via Visa or MasterCard, bank cards or by bank transfer into the amandla.mobi bank account, the details of which will be provided on request.
8. Card acquiring and security; Card transactions will be acquired for amandla.mobi via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
9. Customer details separate from card details; Customer details will be stored by amandla.mobi separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za
10. Merchant Outlet country and transaction currency; The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
11. Responsibility; amandla.mobi takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
12. Tax receipt; amandla.mobi issues electronic tax receipts (Section 18A certificates) at the beginning of each year. Donations with a total donation amount of R100 or more per year are eligible for a tax receipt.
12. JURISDICTION AND APPLICABLE LAW
1. The terms and use of the Website and/or our mobile channels shall be governed by the laws of South Africa shall be subject to the exclusive jurisdiction of the courts of South Africa although we retain the right to bring proceedings against you for breach of these terms and conditions on your country of residence or any other relevant country.
2. This website and/or our mobile channels is governed by the laws of South Africa and amandla.mobi chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
3. If there is any conflict between these terms and conditions and any rules and/or specific terms of use appearing on specific sections of the Website and/or our mobile channels, then the latter shall prevail.
4. amandla.mobi may, in its sole discretion, change this agreement or any part thereof at any time without notice.
